An update from Flamstead Parish Council:
Dear Residents,
We wanted to provide an update following today’s High Court judgment regarding the ongoing situation at Friendless Lane.
The Court has now issued its decision following the hearing on 7 May.
The Judge has ruled in favour of Dacorum Borough Council and has confirmed that:
- The existing injunction will remain in place
- The application to remove or weaken the injunction was refused
- The Court accepted that unauthorised development has taken place on the site
- The Court found that development continued after the injunction had been granted
- The Court also concluded that the site was not occupied in the way claimed prior to the original injunction being issued
The Judge further confirmed that the legal process should now move forward towards a speedy final hearing.
Importantly, the injunction restrictions remain active. This means the prohibitions on further unauthorised development, additional caravans, operational works and residential use of the land continue to apply unless altered by the Court.
The Parish Council remains in close communication with:
- Dacorum Borough Council
- Hertfordshire Police
- Relevant agencies and representatives
We would continue to encourage residents to:
- Report crimes in progress via 999
- Report non-emergency concerns via 101
- Continue providing any relevant evidence or updates to the Parish Council and Planning Enforcement where appropriate
We appreciate this has been an extremely difficult and emotional situation for residents. However, today’s judgment represents a significant stage in the legal process and provides important clarity regarding the Court’s current position.
We would also like to thank residents for the continued calm, patience and support shown throughout this process.
