Update from Flamstead Parish Council
Following the update issued yesterday regarding the High Court judgment, we wanted to provide some further clarification on the current position and the process moving forward.
Yesterday’s decision was a very positive and significant step for Dacorum Borough Council and the wider community.
The Judge:
- Continued the injunction in full
- Refused the application to weaken or discharge the injunction
- Accepted that unauthorised development had taken place
- Accepted evidence that works and activity had continued after the injunction was granted
- Did not accept the defendants’ claims regarding occupation of the site prior to the injunction
The judgment considerably strengthened the Council’s current legal position.
However, we also wanted to carefully manage expectations regarding what the ruling means in practical terms.
Whilst the injunction remains fully in force, there are still further legal and planning processes to follow, and the judgment itself did not result in immediate removal of the site or immediate clearance works.
The Judge indicated that the matter should now proceed towards a speedy final hearing, and the Council will continue to determine the next appropriate legal and enforcement steps in line with that process.
Importantly:
- The injunction restrictions remain active
- Further unauthorised development remains prohibited
- Monitoring, evidence gathering and enforcement activity continue
Residents should continue reporting:
- Crimes in progress via 999
- Non-emergency concerns via 101
- Any significant site activity or evidence to the Parish Council and Planning Enforcement
We appreciate residents’ continued patience and support throughout what has been a very difficult period for the village. Whilst there is still a process ahead, yesterday’s judgment represented a very important stage and provided considerable reassurance that the concerns raised by residents and the Parish Council have been recognised and taken seriously by the Court.
