Update from Flamstead Parish Council:
Dear Residents,
We wanted to provide a clear and factual update on the current position, including the legal process, planning timeline, and arrangements over the weekend.
Legal Process
The Council is currently progressing active legal proceedings, and as a result, there are limits on what can be shared publicly at this stage.
- The Council is taking specialist legal advice on the available options to enforce the terms of the injunction
- This is being kept under ongoing review as the situation develops
- The next key stage in the legal process is the court hearing on 7 May
A further update will be provided following that hearing, once it is appropriate to do so.
While we appreciate residents want more detail, it is important that information is managed carefully to ensure the strongest possible legal position is maintained.
Planning Timeline
The planning application is currently going through the formal process.
- The consultation period closes shortly
- All responses, along with input from relevant consultees, will be carefully reviewed by planning officers
- The application will then be prepared for consideration by the Development Management Committee (DMC)
This process requires thorough assessment and is expected to take several weeks, with the application likely to be considered in June (subject to review).
What happens next:
- A recommendation will be made to the Committee
- The Committee will make a decision on the application
- A formal decision will be issued shortly after
If the application is refused, the applicant has the right to appeal:
- Any appeal would be considered independently by a Planning Inspector
- The Inspector would review both the application and the Council’s reasons for refusal before making a decision
At this stage, as the application is still under consideration, no further commentary can be provided on potential outcomes.
Weekend Arrangements & Reporting
The Council continues to work closely with Dacorum Police, and we are grateful for the support being provided.
Over the Bank Holiday weekend:
- The Council will operate a triage process for any potential breaches of planning control
- Where necessary and proportionate, further action can be escalated, subject to legal advice
Current legal advice is to continue to gather evidence of any changes or activity on site
